NORTH KINGSTOWN—This past week, the Town of North Kingstown, represented by Providence lawyer Marc DeSisto, settled with the estate of Mark Kilcline in U.S. District Court and will pay $7 million in damages, although the decision has yet to be finalized. Kilcline, who passed away this past April, was fatally shot by North Kingstown Police in February 2009 while being transported to Butler Hospital as a patient.
Kilcline, who had a history of mental illness, filed a 12-count lawsuit in October 2010, alleging that police officers John Urban, Daniel Silva, Kevin Gleason and then Police Chief Edward A. Charboneau committed wrongful death, excessive force and discrimination based on disability, among other reasons, in the death of Kilcline. The town itself was also named as a defendant because of its employment of the said police officers.
