The Administrative Procedures Act (APA), regarded as one of the most important pieces of administrative law, requires (among other things) government agencies to review petitions send by the public and respond to them in less than thirty days.
Six months after the ACLU sent a petition to the Rhode Island Board of Education, still without response, the ACLU filed a lawsuit against the board. Last Friday, a judge ruled that the board of education acted in violation of the APA by ignoring the multi-organization petition, which was filed in June to seek a hearing to repeal the NECAP graduation requirement.
